Recruitment Data Protection Declaration

CodeXTeam (Codex Team FZ-LLC) or one of its affiliates (collectively "CodeXTeam") is willing to consider you as an individual ("You") for employment. CodeXTeam requires You to provide certain personal data in order to carry out the recruiting process, process Your application for employment, and potentially conclude an employment agreement ("Recruitment Data"). Except as specified in this Recruitment Data Protection Declaration ("Declaration"), CodeXTeam’s privacy statement, available at https://www.iubenda.com/privacy-policy/13351143/legal, as CodeXTeam may update it from time to time, governs CodeXTeam’s collection and processing of Recruitment Data.

Information CodeXTeam Collects

CodeXTeam always collects and processes the following Recruitment Data:

  1. First name;
  2. Surname;
  3. Telephone number;
  4. E-mail address; and
  5. CV/Resume, which includes any other information that You choose to put on your CV/Resume, including, without limitation, employment details, education history, skills, languages, professional certifications.

CodeXTeam may collect and process the following Recruitment Data, if You decide to provide it to CodeXTeam:

  1. Current place of employment;
  2. Current title;
  3. LinkedIn account and information listed on it;
  4. Social media accounts and information listed on them;
  5. Links to your websites;
  6. Address;
  7. Gender;
  8. Education;
  9. Employment status (currently employed or not) and employment type (e.g. full-time, part-time, intern);
  10. Cover letter;
  11. Qualifications; or
  12. Any other Recruitment Data, which You provide voluntarily.

If CodeXTeam selects You as a candidate for employment, CodeXTeam will request some additional employment data that the local laws require for the creation, negotiation, execution, and delivery of an employment agreement.

Special Categories of Personal Information

In the initial stages of the recruitment process, CodeXTeam does not seek to collect special categories personal information (also known as "sensitive personal information"). Special categories of personal information include information revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade-union membership, genetic data, biometric data for the purpose of uniquely identifying a natural person, information concerning health, and information concerning a natural person's sex life or sexual orientation.

CodeXTeam may need to collect some special categories of personal information from You at later stages in the recruitment process, if local employment or social security and protection laws require CodeXTeam to do so. CodeXTeam will notify You explicitly about such processing.

Please do not include any special categories of personal information in Your application documents. If you provide such information to CodeXTeam, you agree that CodeXTeam may use this information in accordance with applicable laws and in line with this Declaration.

How CodeXTeam Processes Personal Data

CodeXTeam processes Recruitment Data for the following purposes:

  1. Recruitment and contract initiation
    1. To identify You as a candidate and preliminary assess Your application;
    2. To communicate with You about recruitment and employment;
    3. To prepare, share, negotiate, and execute documents related to Your recruitment and employment; and
    4. To process Your requests in relation to recruitment.
  2. Settling of disputes, as well as exercise and defense of legal claims.

The processing of personal data is necessary to achieve the above-mentioned purposes. Unless explicitly stated otherwise, the legal basis for the data processing is CodeXTeam’s legitimate interest for performing recruitment and if a candidate is selected - for the performance of employment contract. CodeXTeam may also rely on consent, if You decide that You wish CodeXTeam to keep Your data for future vacancies and further job opportunities.

CodeXTeam does not process Recruitment Data other than for the purposes this Declaration lists.

If CodeXTeam selects You as a candidate for employment, CodeXTeam will process and store your Recruitment Data for the creation, negotiation, execution, and delivery of an employment agreement, as well as subsequent maintenance of the employment relationship.

If CodeXTeam does not select You as a candidate for employment, CodeXTeam will keep your Recruitment Data only as long as CodeXTeam has a legal or business purpose to do so and in accordance with the local regulations. The precise period may vary depending on your region. If You want to receive more country-specific details, please contact us at dpo@codex.team.

You can also give CodeXTeam consent to store and process your Recruitment Data for a longer period in accordance with local regulations. We may send you additional communication at the end of this period to confirm whether You still want to remain in our database or update some of your Recruitment Data. If You would like CodeXTeam to keep Your Recruitment Data for potential future recruitment, You may give CodeXTeam consent for this by clicking the appropriate check-box. You can always revoke previously given consent by contacting CodeXTeam at: dpo@codex.team.Your decision to give or withhold consent does not affect the likelihood of CodeXTeam selecting You as a candidate for employment.

CodeXTeam does not carry out automated decision-making, including profiling, of personal data in the course of conducting its recruitment.

CodeXTeam may transfer Your Recruitment Data to countries other than the country of which You are a resident and process Your Recruitment Data in such countries.

For cross-border personal data transfers, we use appropriate safeguards to require that your personal information is protected in accordance with our Privacy Statement (as it may be updated from time to time and available at https://www.iubenda.com/privacy-policy/13351143/legal). These safeguards include implementing the European Commission’s Standard Contractual Clauses and other valid mechanisms for transfers of personal information between our affiliates and processors.

CodeXTeam treats all of the Recruitment Data confidentially. CodeXTeam only makes the application documents available to those persons who are directly involved with the filling of the vacancy, and, for applications that are also appropriate for other vacancies, to those persons who are directly involved with the filling of those other appropriate vacancies.

Toggl Hire Platform

Toggl Hire OÜ ("Toggl Hire") provides a recruitment software platform (the "Tool") to CodeXTeam. CodeXTeam uses the Tool for gathering Your personal data under this Declaration. The Tool's privacy policy, as it may be updated from time to time, is available at:https://toggl.com/hire/privacy.

Withdrawal

You provide Recruitment Data voluntarily. You can revoke Your consent to the collection and processing Recruitment Data at any time. However, Your Recruitment Data is necessary for the recruiting process. In the event of a revocation, CodeXTeam cannot consider You for employment.

You can also revoke previously given consent to CodeXTeam for keeping Your Recruitment Data for potential future recruitment. Such decision does not affect the likelihood of CodeXTeam selecting You as a candidate for employment. If you want to revoke such consent, please contact CodeXTeam at: dpo@codex.team.

Terms and Conditions of Use

By using this recruitment tool ("Tool"), you agree to indemnify CodeXTeam, its officers, directors, employees, successors, agents, distributors, and affiliates for any and all claims, damages, losses, and causes of action (including attorneys' fees) arising out of or relating to any content that is provided by you (or through your user I.D. and/or password). You agree to cooperate as fully as reasonably required in the defense of any claim. CodeXTeam reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you.

Your use of the tool is at your sole risk unless otherwise explicitly stated. The tool, including the information, services, and content is provided on an "As is" "As available" and "With all faults" basis. CodeXTeam disclaims all express or implied conditions, representations, and warranties of any kind, including any implied warranty or condition of merchantability, satisfactory quality, fitness for a particular purpose, or non-infringement. CodeXTeam makes no representations, warranties, conditions or guarantees as to the usefulness quality, suitability, truth, accuracy or completeness of the tool.

CodeXTeam makes no warranty or representation that: (a) the tool will be uninterrupted, timely, secure, or error-free; (b) the results that may be obtained from the use of the tool will be accurate or reliable; (c) the quality of any content, information, or other material obtained from the tool will meet your expectations or requirements; or (d) any errors in the tool will be corrected.

You assume all risk for any damage to your computer system or loss of data that results from obtaining any content from the tool, including any damages resulting from computer viruses.

Where applicable law does not allow the exclusion of implied warranties, the foregoing exclusions may not apply to you.

Neither CodeXTeam, nor its officers, directors, employees, agents, successors, subsidiaries, distributors, affiliates, or third parties providing information on this tool are responsible or liable for any special, incidental, consequential, punitive, or other indirect damages that result from the use of, or the inability to use, this tool or the information contained in this tool, even if CodeXTeam (or any third party posting information on this tool) has been advised of the possibility of such damages. In no event shall CodeXTeam's total liability to you for all damages, losses, and causes of action resulting from your use of this tool, whether in contract, tort (including, but not limited to, negligence) or otherwise, exceed one dollar (US$1.00).

To the extent that any jurisdiction does not allow the exclusion or limitation of direct, incidental or consequential damages, portions of the above limitation or exclusion may not apply.
